No Escape From AT&T Data Charges

Users of cellular phones have unfortunately grown accustomed to seeing a series of seemingly small, and inexplicable, "surcharges" on their monthly bill.  These add up, and over the life of a contract, can total significant sums.

Rather than explain — or better, remove — these fees, AT&T is now charging consumers a surcharge to protect against false charges imposed by AT&T!

Many of these surcharges relate to fees for data usage.  While a consumer readily can assess how many minutes are used by a phone call, knowing how many megabytes of data are being transferred is substantially harder to limit and control.  Consumers regularly receive monthly bills showing data charges in the hundreds of dollars for unknowing, or unwitting, use.  In many cases, an application was running in the background without the consumer’s knowledge and, often, without the consumer obtaining any benefit.  Or a simple text message, attaching a picture, is charged once for the text message and yet again for the data transfer of the picture.  In still other cases, the data charges are entirely wrong.  Many consumers insist they do not send or receive any data and simply use their phone as, well, a phone.

So, the simplest solution may be to just block data usage on your phone.  Unless, of course, you are an AT&T customer.

AT&T charges its customers a $10 monthly surcharge to block data usage.  AT&T knows that it is nearly impossible for most customers to track their data usage and this is the easiest way for them to generate huge fees.  So, they are unwilling to permit consumers to prevent any data related charges by simply blocking data from their phones — unless, of course, consumers are willing to pay $10 for the privilege of not using a service.

If you or someone you know has suffered false or inflated data charges from AT&T, or have been unable to block data use without paying an additional surcharge, please contact us to discuss your legal options.

I’ve had a 2line family plan with ATT since Dec 2009. The services has been $64-68/month until the recent bill for May 1, 2011. We are now being charged for a data plan. I can’t get it removed and ATT says just because I have an iPhone I have to pay for the data plan. I only use this as a phone with occcasional use of the home wifi network. I’ve NEVER used 3G or data!!! Both functions are turned off and ATT even recognized no data had ever been transmitted. Yet, I now have to pay for a service I don’t want, didn’t ask for, and won’t use. And because it’s a 2 line account with 2 iphones that weren’t purchased from ATT, by the way, I have to now pay an additional $30 on an account that previously averaged about $65/month. This is a ripoff!!
Would going to the FCC or the FTC help in anyway?
    thanks
    Kathleen

Yes, I to have been muscled by AT&T. I also have two lines with five phones on them for my whole house hold and I even threatened AT&T to cancel my accounts if they remove my unlimited data because of tethering that didn’t happen, as there was noway for my phone to tether without their plan. Something must be done, this is a violation of our rights as citizens of this country. Who shall save us from the BIG fish eating the small fish situation?

Have 5 phones in the family plan. $2-4 each months surcharges for data use. Very annoying.

This is a HUGE problem. I am suprised the Federal Trade Commission has not stepped in on this. It seems highly illegal to force a customer to have to spend more money with your service without them getting a decision in the matter. The data charge IS a total separate charge on the bill which means it is ADDED on. I asked a rep why data is required. There are background programs running that need data access. BUT, those programs can access the same data through wi-fi. So my original question was why do I need data? Could not get a clear answer other than data is required with all smart phones. So why is the data charge still separate on my plan if it is required? I tried to have data disabled but was then told it was impossible, and that it would also block MMS messages. Thats funny because MMS messages do not use from your data plan amount. The system knows the difference, but yet if you want to disable data, all of the sudden it cant tell the difference anymore. Something needs to be done!!!

I have often wondered if anyone has / will file a lawsuit on this issue. My situation is similar to Kathleen’s in that my 13 yr old was given an iphone when her basic phone broke and I “opted out” of the data but every month they have charged my account and until this month they would credit it but now they refuse — so I am going to Verizon. It is terrible for people who do not review their bills — I am sure that plays a part in ATTs multi million business — because they are stealing a lot of it.

My 14 year old son got a smart phone for his birthday and AT&T refuses to lift the smartphone data plan or even block data all together. He has wi-fi everywhere he goes and 3g is always turned off. Also, they cannot seem to effectively switch me to the $15 a month plan because this phone does not support it?? Paying $25 per month for a service that he is not even allowed to use is ridiculous. What’s more, the phone is unlocked and was bought from another source. My other son also has an unlocked android phone but since it was originally a T-Mobile phone, AT&T has not tried to charge for a data plan on that phone. Both phones provide the exact same functionality and service. AND his phone is not even under contract anymore. He is outside of the 2 year window, so his line is paid month to month. . . Looking forward to all five of our phones being outside of the contract. Dealing with AT&T is very frustrating.

AT&T is now bullying costumers to pay for data plan if you use a smart phone. Even if u didn’t purchase a phone through them or contracted to use data. I am sorry I thought this is AMERICA not a communist state where Americans get to chose what phones to use. What if one day cable companies and Internet companies tell you what computers to use or tvs to buy?!?!?! This is robbing!!! Please spread this around!!! Thanks!!!!

Is there anything I can do about AT&t taking me off of my unlimited data usage plan? Apparently when I upgraded I didn’t relize they had dropped it. I didn’t know because I didn’t use any data to speak of at the time. I got it so I wouldn’t have to worry about it. Now they are charging me about 10 bucks a week for overages on data. I already spend 145/month on my iPhone plan. I have talked with phone jockies till I’m blue in the face. I am going to try and call one more time today, but after that, I’m prepared to get nasty. Thanks for listening to my rant. If I have a leg to stand on please contact me.
